He is on trial for killing a very, very small number of people as compared to the hundreds of thousands he supposedly killed. If the number was really that high this case would be a slam dunk for the prosecution, but it's not. He could be found not guilty.
That article talks about the Iraqi's he killed after they were found to be involved with Iran in an assassination attempt on Saddam. Prosecution says people were swept up that were not involved, but this is to be expected in that part of the world. The legal system in those countries can not be expected to be as precise as the west.
Saddam himself should not he held responsable for this particular event anyway. It's like trying Bush for murder because a secret service agent shot and killed the wrong person.
