1) Well, I'm not sure you can get off the hook by taking other people's word or with a TOS.
2) You don't seem aware that to have any CP on your computer is a felony, even if you didn't put it there and even if you delete it right away. It's what's called a "strict liability" offense.
As I understand it, if you want to go the "we are just a wire...we don't filter anything...that responsibility belongs to the submitters" the way, for example, the phone company isn't responsible for what travels over their wires, then you must NEVER intervene, must never review, must never discard.
So, your two points are in conflict with each other, you can't hide behind 1) if you do 2).
