Dunno what the "rules" are in the US notabook - but know of a law agency person there who would never pull a gun unless they were going to use it. And she played a role in a previous existance as a firearms instructor with 1000's of police officers.
Can think of two other instances - not in US, but where an asshole officer managed to shoot himself twice in error. Another was because a guy raised a fork in a restaurant and a cop pulled a gun in response - even fired - but the gun never went off
