The non US webmasters who have a presence, or are establishing one, in the EU or other regions where their particular processor has merchant accounts, are subject to the requirements in that region, all of which should fall under basic Visa International guidelines that have been established.
Currently EU banks are not charging any fees for Visa in that region, however that does not preclude it happening in the future.
We deal directly with a European third party processor which is not US based at all, and this is what we have been advised by the owner of the company. However, to use their services with Visa processing, we will have to form a corporation in the EU, otherwise they cannot process for us, since we have no presence in their region.
As for refunding any money, I think that is a bit ridiculous to assume. Unless Visa declines the US sponsored merchant processing, the fee is gone, and will not be returned unless the processor is rebating it, as many have opted to do.
This is not a matter of rejecting webmasters without a US presence, this is simply a matter of Visa enforcing a rule thats been on their books for quite some time tho ignored all that time.
