The guys a fucking legal moron. Nobody is in threat of the "incidental" inclusion of material in videos.
The issue is simple: Stick to "fair use" or just don't post videos that you didn't make.
Nobody's going to get into trouble for a 5 sec clip of a TV show; but idiots post the entire show.
Everybody in this post would be ready to kill the guy if he posted all the full length movies of your paysite. Hey, but a 5 sec clip with the URL, you'd love him.
That will make Utube better in the long run because it will then be worth it for people to put some money in producing top video since they will now get credit and be able to control their product.
