Zango isn't spyware, I can see it, but I can't stop it, I can't call the police, I could block the visitors but I have Zango members, so that would be stupid.

Doesn't make it less shady and just because they haven't been challenged in court yet doesn't mean it can't be done successfully. All you need is a slick lawyer.
