I say he did his part of the deal, as you paid him the $200 you owed him, though you are not paying him the 5% as the other part of the deal.

No, you'd confront the person, and in your case, about it not being adequate. As opposed to contacting Alky, you just stopped using his script, and assumed/thought your verbal contract was void. Of course, the problem here is that it's 1-vs-1 as to what the contract was...
