it takes the industry uniting to go after them and get your shit out of their network by no one sending them traffic. unfortunately many people will send them traffic to make money and not support the content producers. ruining their image is about the only thing you can do unless you try some sort of class action or is someone gets wiley and ddos the shit out them, which i want no part of anything illegal. doing something illegal against something illegal doesnt make me feel vindicated.

close - but the real issue with guba is they are merely a simple and easy to use frontend to certain allowable newsgroups. Can't sue, they aren't doin the hosting - their just a newsgroup provider... and that's been a gray area since it's creation.
