Fraud: My bank, Visa or PSWBilling?

I am unexperienced with banking, hope you will read this horror story and help me what to do now:

I ordered DVD with my Visa card at some internet shop. Shopper used PSWBilling to bill my credit card. After few days i got message from shopper and psw that transaction was declined because of credit card number error. I checked the number i gave them and called to my card issuing bank. It is the biggest bank in our country. They told that there was no error and transaction was accepted, my $40 was transferred. So i am without payment, shopper is without payment and this situation lasts already 50 days!

PSWBilling is telling transaction was rejected by visa, visa blocked payment but did not take it. It is my bank who blocks my funds. They are sure and are talking that transaction reports from my bank i am showing them only prove that funds are blocked.

My issuing bank is telling transaction was accepted, visa took funds and sent it to merchant bank. They are sure that PSWBilling shaves or its bank block it for unknown reason. They sent me many complicated papers where are details of transaction, i do not understand all items but there is stated transaction approved and they are telling they have this transaction in list of outgoing transfers to visa.

I thought that it could be easy solved if i ask directly visa: Is my bank right or PSWBilling? But both sides told me that it is impossible to contact Visa, because they have no customer support. Both sides are telling they have sufficient proofs they are right if i take legal action agains them. And of course, there is also possible that it is visa who is holding my funds. They could send different results to my bank and psw and keep my funds laughing to our faces!

How to solve this situation? Shall i leave $40 to thief without searching who it is? My bank offers to charge back for reason goods not delivered. They do not know reason Merchant did not received funds because they are telling it is impossible! Hard to say what happens but i risc that the chargeback fee will pay the shopper, only one person who is really innocent, because psw billing states they did not pay him. And i risc that PSW will add me to negative database and share it with other processors.

Can anybody here tell me what to do to find the truth? Any possibility how to contact visa or how to sue them? Because if i would go to the court i would start with visa. But they seem to be anywhere and nowhere...
