What makes you american based? Is that just server location or domain company? Or you have to be a US resident?

If you are either living in the US or operating a business within US territory, - it would normally be fair to say you are "US based" and would be obliged to comply with US laws.
The location of the server is another element. If you contravened a law (eg obscenity law) in a country where your server was based, it is possible that country may be interested in prosecuting. However, in reality, unless any offense is an "extraditable offense" and assuming you are not a US citizen, it is most probable that this would not happen. The most that may happen is that your server would be closed down.
If you are not resident within the US or a US citizen, there is no reason to have hosting within that country or pay any attention to it's laws. It simply does not make sense to operate within an undesirable environment for an adult business.
