Is the host or registrar a reputable one? I wouldn't even bother messing with the guy or contacting him directly. Have your lawyer send a letter to both the host and registrar (if they're reputable) and make sure there is enough paperwork, with proof of illegal activity and some "threats" kind of (just shit saying you will take legal action). Hopefully if done right both the host and registrar will take down his hosting account and domains (more likely the host will do something about it).
This will completely fuck the guy over, he'll loose his domains and all the shit on his web space. Which he probably does not have backups of. It should be such a loss the guy will be too scared to try something so bold again.
P.S. If possible, combine your efforts with another program which he is doing this to. Letters from multiple companies will for sure bring it down.
