You are oh so right that I could have filed my complaint upon the very first instance of defamation on GFY.
BUT, my schmucky friend, I believe my e-mail and posts have helped.
My posts and e-mail have served as a C&D.
MY posts and e-mail are pleading for the defendants to do what is right BEFORE having to go to court.
My posts and e-mail will be viewed by the Judge and the Court as a STRONG attempt at avoiding litigation.
My filing of the complaint will be viewed as the absolute and final step I can take to rectify the situation and stop the libel.
If I filed without warning, then there will be some question as to some of the defendants. I want EVERYONE who wants OUT to be able to get out.
I have a tremendous amount of experience with the Courts so I believe that I am doing the "smart" thing.
To all potential defendants, GET OUT WHILE YOU CAN! Have your libelous posts deleted or risk being added to this civil case.
I also want to be able to have my attorney ask, "Why is it that you did not retract your libelous statements when given the opportunity?" and "Why is it that you continued to post libelous statements when you knew a law suit would follow?"
Then I want to hear the stuttering and stammering of the defendants and their attorneys as they try to explain that they thought it was all so fun and that they thought nobody would ever REALLY sue them.
