1- I don't believe that most Terms of Service on websites allow for anything other than a local copy to be downloaded and retained. They certainly don't allow you (as a member/subscriber) to redistribute the content to another former member/subscriber.... fine, perhaps this is against standard case law and people are allowed to find backups.. my problem is that there is no policing of what they deserve to have.
If a member was active until October 31, they don't have a legal right to anything beyond October 31 and they also don't have a legal right to distribute beyond October 31.
I don't have a problem with TPB doing what they do, except for the fact that there is no verification of who deserves what. The pirated content is membership level content. Your cable television content is also membership level content but at a different level of distribution.
If they required verification that someone is legally allowed to have a backup, I would have no issue with it. But of course they don't, and of course they won't. They are distributing the locations of content. Its as bad as someone saying I don't traffic guns, or underage girls, or prostitutes, or drugs, but if you give me a little money, I will show you where you can have at them for free. Hey, do I need to prove to you that I legally have a right to these things? Nah.. don't worry about it... the laws don't require us to do that. Just raise your right hand and promise us that you have a right to possess it and we are fine with that!
That's completely laughable. Whether the Swedish law is what it is and how fucked up the US law is.... people that don't deserve it are profiting from re-distributing content (actually content locations).
I personally would love to see the US law re-written that allows a policing of foreign sites which can immediately block access based on violations of this sort. It would then be up to the site to prove that they are compliant before their access is re-assigned within the US. Guaranteed that they would shut down almost immediately because it is conceivable to believe that most of their funding and traffic is US based.
As I have said before, There is the legal answer and then there is the ethical and moral answer. The people at TPB are doing what they legally have a right to, but they are profiting from something that is morally and ethically wrong. They know that people are downloading content/warez, etc that they have no legal right to (and even providing them with crack codes, which someone previously said.. what would you need that for if you already owned a legal copy??? Yeah, I know.. it's not illegal to download a copy, the only illegal part is to use the crack code.. unless of course you already had a code.. but lost it.. which means you still have a right to possess the copy and use it... it's just too bad you lost your code, right??)
They are telling the world to fuck off because they can.. but realistically, you would expect things to change against them. I personally think they are worthless, slimy shits that deserve whatever fucking over they get and if someone is hacking their site, I don't feel it's any worse than someone providing the location to my content for others to use illegally. Granted, it's a matter of semantics, and location and situational ethics.. but when you get right down to it, they are fucking with a lot of people and hiding behind a flimsy legal justification. The mob dealt with people like this very nicely in my opinion. More power to whomever might be fucking with TPB and everyone like them. The minute they make their earnings honestly rather than skirting around what they know to be a flawed system, I will have respect for them and would be willing to back them up (can't see that happening anytime soon)
