first of all isohunt has been canadian since it was created, it was created by a canadian, it was incorporated in vancouver. MPAA was able to sue them in US court because they were using a US HOST with a change of venue clause in the hosting contract.
THEY changed hosts to eliminate this loophole
The courts ruled that all infringement claims after that move must be governed by Canadian law. That is a win given the differences in fair use rights between the two countries (because we pay taxes for those additional rights)

They respected DMCA in the past, and still do even though they are no longer under an obligation to do so. Which is the point they were complying with the law and they are getting sued by the MPAA because (like you) believes they should have more rights than the law give them

it is a couple of years away for a win on the legal mess he has gotten himself in (by using a california host with change of venue clause in it) but he is already getting a lot of press that confirms he is actions were complient with US laws.
