you have to ask your self a simple question if it as easy to get a conviction under canadain law why did the MPAA (which has a canadian office in both vancouver and toronto) no file the complaint under canadian law
The precedents are already set, (you mentioned one in the Canadian supreme court decision agains the canadian record association) it a simple extension of that law to apply to all digital media (movies etc)
The MPAA does not want the law extend that way, that why the did not go after a CANADIAN CITIZEN under CANADIAN LAW.
They had to exploit a loop hole to get the court case into the california courts, and those court have limited the exposure to the date they moved their hosting to canadian hosts (since you already acknowledge that in your running to canada reference i will not waste time pulling that link)

I have never said that and you know it i have been repeatly talking about "Fair use" rights. Those are rights granted BY THE COPYRIGHT ACT ITSELF. A copyright does not give you the right to TAKE THOSE RIGHTS AWAY. Your mistaken assumption is that if i own a copyright i have complete control over the rights anyone has with "your" material. GUESS WHAT YOU DO NOT YOU STILL HAVE TO RESPECT THE FAIR USE RIGHTS granted by the act.
IF YOU WANT TO CLAIM EVERYONE WHO USES TORRENTS ARE THEIVES YOU HAVE TO ELIMINATE THE NEED FOR THEIR LEGITIMATE FAIR USES.
I have referenced the court case that grant me the right to download tv shows from sites like tvtorrents.com.
I have licienced the content in question by paying my cable bill
I have licienced the content by paying a tax on recordable media (dvd, cd, hard drives)
And the COURT HAVE CONFIRMED THAT THE LAW GIVE ME THAT RIGHT.

i have written a lot of code which is currently in the hands of mutliple companies. I however DO ELIMINATE the "fair use" access rights of torrents by ALLOWING PEOPLE WHO BUY MY CODE TO ALWAYS HAVE DOWNLOAD ACCESS.
I can complain about piracy because i am not under serving my customers.
I also pay for the services (i am also a part owner) to monitor the torrent sites and to send out dcma complient request for each individual torrent.
