And as i have already pointed out You can't legally TOS fair use away. Rebroadcasting/sharing with someone who has a right to the content is covered by fair use. So in both these cases the seeder does not need your express permission to rebroadcast your content. Your copyright is conditionally valid based on you honoring this right.

the original seeder must have a right to the file, otherwise how else did he gain possession. If i did not buy the file from somewhere (bought the dvd, bought the membership) how exactly did i get the file. it would not magically appear on his hard drive in the first place.
