at no point did i say that all the users were legitimate i am saying that some of users are legitimate.
In this case the same tracker support your porn files and my tv shows. When you hack the tracker you eliminate my ability to get my tv shows legally. I am not stealing from you in any shape or form and you are trying to argue that it is legitimate to punish me.
you can track down the infringing leechers.
if you connect to the torrent with a client like utorrent you get all the ip address of the peers.
Obviously there is a little more leg work to find out which of those people are actually stealing your content. You choose not.

i could use the same arguement with your porn sites, you could ask people to prove that they really the owner of the credit card before you accept it. You don't do it because it your not LEGALLY REQUIRED too. Selling porn to a minor (if done deliberately) is far more sever crime than copyright infringment. If you want to eliminate "mental intent" as a requirement of the crime, then you have to be willing to go to jail for 3-5 years when you choose not to fully verify that the person is actually the age he claims he is.
