The intent of TBP and torrent sites in general is to aid and abet the transfer of files without concern to the legality of the content. There is no requirement for the original seeder to identify themselves and accept responsbility for the distribution, nor does TPB or any other torrent site seem to care that the large majority of thier content is stolen, cracked, hacked, or otherwise illegally obtained.

It is called conspiracy, because each of the steps involved is created to aid the final outcome (files distributed), and each of the people along the way knows that it is likely that the people don't have the rights to do this sort of distribution.

TPB goes one step further, because their intent is to make as much money off of advertising as possible while aiding this illegal distribution. Again, they would have to be morons not to know. They know, and they choose not take action.

You cannot suggest hat TPB is safe behind thier TOS because the owners themselves are very much aware that most of what is on their site is there without permission. It isn't like a porn site that might have a kid sneak onto it, but more like setting up a porn site as a home page in all the elementary school computers. It is overt, it isn't "oops".

Your arguments Gideon are weak because your assumption is wrong as a basic of international law and the WTO, which Sweden is part of. You make an assumption like all users have rights to the files, and that just isn't the case. Nobody has rights to camcorder recorded version of movies that were released in theaters this weekend. Porn movies sell maybe 1000 copies each. There is no way that the owners of those 1000 copies have all redownloaded the material 100 times each. There is no justification for distributing porn site full site rips. Nobody has the rights to do that. But that stuff is all over the place.

If the majority if the material on the torrents there legally, you might have a leg to stand on. 99.9+% of it isn't, and all your huff about fair use is just huff.

Don't you have some files to go seed?
