i have already said that trackers are a potential contributory infringement in the states. and I have pointed out that ISOHUNT made the mistake of allowing themselves to be bound by these laws because they used a host with a change of venue clause so this is not to suprising.

again they need to produce as many fair use examples of the torrent to justify a ruling like betamax ruling. If there are no fair use or legitimate uses of the technology then the arguement that the technology as a whole need to be shut down will falsely win.

Advertising these legitimate uses is just good business sense.
It not an admission of guilt like you want to represent it as.

It appears that the Swedish government is going to move to basically make the ISPs providing the services to TPB liable for the copyright violations.
It would appear that the courts there may be tired of being laughed at by the copyright violators.
i suggest you read it again, this is exactly the intermediary infringement i was explaining to SF.
canadian law recognizes this type of actions, it basically a request to the isp to cancel the people sharing this particular file.

if you are using the torrent in a legitimate way you can stop such a request with a simple 1 page letter explaining why you have a fair use right to download the file.

under that situation the fact that the copyright holder can actually shut down the people who can't prove to their isp have a right to the content, means you can trust that all the members also have legitimate rights.

Go after the torrent files and the trackers you are taking away fair use rights from the legitimate users.
