OK... Question here....
We all know that the woman in Minn lost her case, she was sharing a bunch of music files, entire files, via Kazza or something ... Ok, she was giving out the entire file illegaly to someone else.
But, this is the part that has me thinking about the torrent issue.
1. the Torrent itself is just a pointer/marker... No part of that file is our copyrighted work.
2. no 1 person is delivering the resulting file to you, your getting little pieces of code from various sources. (And resharing those pieces as you get them)
3. The file is worthless, untill it's fully downloaded (This may or maynot be the case but from what I have seen partial downloads result in unreadable garbage)
I guess my point here and main question is who do you go after? I guess you would have to go after the original sharer of the file, as he really is the only person you could PROVE had the entire file and shared it. (Fortunatly finding the original uploader should be simple enough as these guys tend to "tag" the files they share.
Going after the original uploader of a file to rapidshit/megaupload would seem to be a better battle, nailing them for ever instance of the files being downloaded. At least the entire file is actually there and being shared.
Or Going After one of the other "tube" sites where the file actually is there and being shared.
