i can see your points but John threw out the lawyer thing and that set this guy off. Assuming he has nothing then he wins because he has nothing to lose.While John has alot to lose and I think in the future before throwing out the watch what you say or your getting a c&d.Unless he knows the person, he should think about that on the net you have no idea who you are dealing with or what they are truly capable of. One well focused person with a internet connection can cause a shit storm.
