well it the only independent research i can point to (using statistical sampling rules the number could be agregated to other markets - like adult content)

i haven't seen a single independent study or report for the adult industry, and if the numbers were as great in the case of infringing use (99.999999%) using services like the company i am a partner in you would be able to slow the torrent speed to a crawl by sending connection termination request to the isps of the infringing users.

It not that hard to solve the problem without targeting those who are using the torrents as a legitimate recovery/backup solution.



The fact is given the liciencing of content (videos licienced to multiple sites), the multiple format streams (VCR, DVD, Ipod, etc), and shear volume of content you are selling a right to view with 3 day trials. I would suspect the amount of case law defined fair use (betamax case, rio case, decss, etc) the percentages are even higher.

but again i could be wrong, just point me to the independent research study that proves that 99.99999999% of adult torrent traffic never purchased any right to the content.
