It seems if one owns a tube site they must be ever vigilant in removing stolen content. It seems like you'd still have stolen content everyday for at least a few minutes before it was removed. Heck, take a week vacation, and bam, stolen content everywhere. It just seems that there's a big gap between willful content theft and leaving users to run amok.
Also, the rogue employee defense isn't exactly unique to any industry. It seems like any company whose stock loses some value blames it on someone, fires them, and moves on. Does anyone really need a scapegoat firing here?
