So, one could be still sending traffic, but if no NEW MEMBERS joined in the last 90 days then sounds to me they're going to steal your money.
If this is true then perhaps a breach of contract suit will fix them.

They didn't say anything about having to have new members. They said if you removed your links that the business relationship has been terminated by the affiliate and the account would be terminated.
