Stating a belief as fact does not make it a fact. If you have proof that it is an employee that is UPLOADING the video then Safe harbor provision does not apply. The viacom is looking for such proof in the youtube case.
Vice versa youtube is looking for people within the production chain who uploaded the video therby giving implicit consent. In the case of america's best dance crew, that could be any of the dancers, any of randy jackson production company, any employee of mtv, any employee of affilates (much music) and finally any employee of viacomm.
Your videos have similar production chains, so even if every video was personally approved by a porn hub employee they can never be sure if it is truly authorized or not.
If there is any automation at all, then it gets even worse.
