For one, good luck trying to link an IP to a person and make it stick in court, the government is having plenty of trouble with that one as it is, let alone corporations. More good luck facing the torrent of privacy-related litigation, and getting a handle on the bad press stemming from "omg this adware company is stealing your ip".
For the other, brighter minds have considered the idea and abandoned it, most notably among them Adobe, Sony and if memory serves the ppl at PARC.
It's that more money wasted chasing faeries, but hey.
