only thing redtube is doing is publishing content without the permission of the copyright holder.
That does not mean they don't have legal right to do that
the safe harbor provision of the DMCA gives them that legal right.
which makes it legal.
just like the supreme court case in california makes shooting porn legal.

The law makes both legal
what would otherwise be illegal (paying for sex) is legal given a specific condition (filming it)
likewise what would otherwise be illegal (copyright infringement) is legal given a specific condition (safe harbor provision)
