It's obviously a loop hole. It's also obvious that "user uploaded" sometimes, if not most often, means that the tube site themselves are doing it. You could buy a trial membership at any major sponsor, and have your outsourced worker ripping and uploading movies and it would hardly cost anything at all.
That's the problem. Either DMCA needs to be changed, or google needs to lose to Viacom over youtube. Until then, it's kind of tricky.

True to 'some' degree.
A pattern of abuse from a site/company, and complaints from the company effected will put them in a place to be sued.
Same for those who do ANY moderation of use submitted content. So if they complaining site can prove that, the offending site is in a sling. Obviously, both can be easily proven if someone has the balls.
