It isn't illegal everywhere to fuck a girl while sleeping. In Australia I believe it is legal providing there is previous consent for you to do such. It's like if your gf says to you sober you can fuck me if I pass out, and than you do it later that night when does that - it isn't rape. Rape by it's definition is having sex with a girl without her consent.
