Fox news isn't reporting "what happened" here, they're reporting what is being alleged in the lawsuit.
Lawsuits are filed with the intention of settling, not with the intention of having to prove in court that what's in your complaint is actually true.
This lawsuit, like many others, was probably filed specifically for the purpose of creating this news story and the public outrage that will follow.
"If" Fox News had any credible reason to believe this were true, it would be the lead story on their newscast and on the front page of their website....not buried in the health section as a story reporting what was alleged in a lawsuit.

Let me repeat this quote from the story:
"An autopsy determined Williams' baby ? she named her Shanice ? had filled her lungs with air, meaning she had been born alive, according to the Department of Health."
FACT: The baby was born alive. She was by ANY definition an actual human being with rights at that point.
FACT: 911 was not called.
