If it was published before 1923, it's in the public domain. It it was published after 1963, it probably isn't. If it was published between 1923-1963, it's in the public domain unless the producer extended his copyrights (which companies like Playboy did, but most amateurs, smaller production companies , etc. didn't). Anything published after 1963 won't go into the public domain for another few decades.

Probably never. Disney's copyright on Steamboat Willy expires in 2022, so that means before then they'll lobby and get another extention of copyright. Copyright was never supposed to be guaranteed forever.
