The way the state of NY forced amazon and others to collect NY state sales tax on sales is based on affiliates. They claim that since amazon (and others) have affiliates based in the state of NY, that this constitutes a "physical presence" in the state, and therefore subject to the same tax structure as a brick and mortar in the state. I think it was overstock who actually banned/terminated affiliates from the state as a way to fight it. Might have that wrong though.

not at all sure how that would apply to a non-tangible like access to a website.
