Doesn't matter as the TM is sextube and not the word tube. So NO he can not sue youtube.
I can see anyone questioning the steps being taken but I can clearly understand what it is to protect a brand. THe thing is that the TM is rather vague I would say as in 2 general words. Thats the problem, but hey Shap if your lawyer says you can get it than I wouldn't care less.
It is a business we are in, why would you have sympathy for someone else really? I mean we are here in the first place to make yourself money not? If Shap would like to make friends and cuddle he would probably do so elsewhere. Don't get me wrong as much as I dislike some of the steps being taken I can perfectly see what is going on, and sometimes you just have to drop the being Mr nice Guy attitude I guess.
