Same could be said of alcohol or even tobacco. With tobacco, again it is just a plant and although you will not be producing Marlboro quality cigarettes you still will have tobacco that can be smoked, chewed, etc. without tax. Most Alcohol can also be easily made at home. We can already see that with how much the whole micro brew culture has grown.
A more valid reason as to why it will not be would be the loss of budgets and income for keeping it illegal. From prisons all the way to grants given to small towns. The sheer number of assorted budgets it has to while it is illegal is mind boggling, and the number it employs is also super large.
