the laws are supposed to follow the principle your rights end the second mine begin.
Right now they don't and it is the copyright holders who have the the better deal.
the DMCA allows you to censor people based on the claim it a copyright infrngement
and to get it back up you have to spend 100k going to court and defending your rights.

contract law is significantly easier to sue for that copyright law
you are either in breach or you are not
you can only sue for the exact economic loss you are incuring not some magical potential lose. no one can claim the judgement is to high.
as a result of setting up a private tracker a 239 script has a loss value of $900/seed
granted i can't turn a profit from suing like in a copyright case, but it stops the infringement cold so i can make my money from the sale of my script
and since i am suing the customer who is responsible for the infringing script

the only difference with misrepresenting as theft is you can pretend that it is cut and dry and ignore those people who are granted a right to your content not because you gave it to them but because the copyright act did.
oh btw i lost income to piracy i thought about hiring a lawyer and sueing after copyright law but the fact is that fair use would have made it a very expensive trial.
that why we tried to figuire out how to turn it into the simple breach of contract dispute
i had no dreams of turning a profit from the piracy i simple wanted to stop it so i could make money on own script.
