gideon, imagine, you know some people who do shady shit on streets, one day your house gets robed, not by the shady people you know, but you find out later that they provided a lead to your house for robbers full well knowing you have stacks of cash - wouldn't you go after those who provided leads as well as robbers?
stop living in a fantasy world, consider your self lucky being able freely "timeshift" shit you have no rights for for so long. and no I wont be dragged into never ending discussion about liberty of some pirates and their rights.
i suggest you look at the history of every fair use battle

sony was convicted of copyright infringment by the lower court before the supreme court overturn them.
diamond rio lost at the lower court level too

each time when it finally got to the supreme court the ruling came down in favor of the "pirates" and a new fair use right came about.

Funny thing is it is always the copyright holder trying to claim a right to deny you the ability to view because we can, instead of for purely monetary reasons.

timeshifting = we have to right to stop you from watching your content at a different time then we give it to you
formatshifting = we have a right to stop you from using it in a different format than we give it to you.

access shifting = we have a right to stop you from viewing it in a different location than we give it to you.

the purpose of copyright law is to protect your ability to make money, it is given to you specifically because the government (on behalf of the people) want to create an insentive to distribute the content. When you abuse that monopoly to take away the right to view, not for monetary reasons but just because you believe you should have the right to do so, then the court ultimately take way the monopoly for that scope.

Access shifting will be a fair use right, but only if copyright holders keep arguing that believe they should have a right to unilaterally deny people the right to enjoy the content whatsoever (i am not going to sell it to bumfuck, whereever at all so you can't have it).
