I guess the simple solution is to change the safe harbor rule to require a host entity to become proactive when the offending content becomes a large enough percentage of it's business, or when content violations exceed a certain percentage of a hosts business.

This could change the game plan for sites such as google or pirate bay and it will add another layer of responsibility and management to conduit sites, but it is time that we recognize that benefit from content should not be derived by people who simply do not have a right to do so.

If people want to abuse the system, then the system must be changed.
