Preventing that abuse is exactly why fair use was put copyright act
it was put there to prevent the copyright holder from saying your technology doesn't perfectly protect me from infringement automatically so you have no right to exist.
Nothing about granting torrents the fair use protection of timeshifting would stop you from find those people (.5% of the us population) who did not pay for the show/given the show and prosecuting them.
