Anyone with eyes can tell the difference between porn and not porn. If you see the naughty bits it can be blocked.

Right and if they are looking at the movies before they are approving them to be listed on the site then they are pre-filtering their content which means that they are controlling the content of the site. Viacom can then argue that if they can set up system to catch porn they can also set up a system to catch copyrighted material. To be covered by DMCA you have to just be a host, by controlling the content on the site before it is listed they are no longer just a host.
