i think the point you are missing gideon is the overall picture.
There will always be legal loopholes that may appear to make an unlawfull act lawfull. at the end of the day if the consensus thinks it should be illegal it will be.
Pretty much everyone will agree the majority of content found/used on torrents is stolen and used illegally. that makes pbay complicit in the minds of the majority.
