If majority rules you lose on that arguement
2. under the current laws (where you don't ignore fair use) a majority of the pirate bays actions is non infringing.
so you lose on that arguement again
3. in the example i have given you the person who sold the content which WAS used in making the Kiddie porn would get convicted.
The current case failed to tell the difference between me using the torrents as a vcr and someone else who used it to infringe. Treating both as illegal under the law (when the "loophole" makes them quite different).
