it depends on which country you are talking about
some countries have ruled that 1 download != lost sale (infringement), establishing the clear difference between infringement when a sale is actually lost and when no sale is lost. others have not yet.
within this thread we shifted between US (when you talked about LA and NY) and sweden (EU) so of course the context of access shifting changed.
