I think if you choose money over putting your childs molester in jail, when you could put him in jail AND sue him civilly and get money.. is the act of someone afraid of losing.
If Jackson was afraid, they'd have offered a plea and he'd accept and by doing so would be admitting guilt.
Settling out of court is what a scared plaintiff does, not what a scared defendant does.
