Of course, Playboy could file infringement all they want. But, the case is whether the consumer would be confused. if my site was all about me being a playboy in my travels around the world, then there would be no brand confusion, and thus no case.
Obviously this case is hypothetical. I won't be buying and building out that domain. Please don't hurt me, Playboy

Right, as long as there is clear differentiation of the products there is no infringing. Or if he bought PornTubeXXX and promoted PornTube, then you are fine there too.
I just want to be clear I'm not saying PornTube is coming after this guy, I don't know if they would even care. I'm just giving a heads up on what has happened in the past and will happen again in the future with similar domain names.
