Of course, Playboy could file infringement all they want. But, the case is whether the consumer would be confused. if my site was all about me being a playboy in my travels around the world, then there would be no brand confusion, and thus no case.

well, chances are he is going to be building a porntube.com like site. just for mobile. yea maybe not the same design. but some sort of video site similar.
