There are plenty of documented examples where this isn't the case.
Here's my TOS: When you purchase this product, you owe me your first unborn child.
A little more seriously, lots of stores use in this 'TOS' hidden gems like
- No refunds on item XYZ
- Item must be returned in original packaging for a refund
- Returns are levied a 10% 'restocking' fee.
Depending on your jurisdiction, these often used 'Terms of Service' - are totally illegal.
In Australia, for example, a merchant can demand all of the above, but none of the above are legally binding.
Normally all it takes is a quick call to the consumer watchdog and everything gets resolved - but in no situation is it the fault of the processing bank,,
