well i can't tell if the issue was overlooked or explictly rejected(as you stated) without seeing the case.
judging from what i know about the pirate bay (50% being tv show traffic+ timeshifting in a cloud to be recognized under the most restrictive copyright laws in the world) i very much doubt it

mpaa tried to get the laws changed to criminalize the vcr
bit torrent would become protected because of "access shifting" and the same attempt would have to be made (change the laws to make it illegal)
odds are in favor that you would simple have to figuire out how to monetize the traffic better like what happened with the vcr
amazingly enough the idea to do it is as simple as put your shit on the cassette and sell it to people. It is just that people are too clueless to get it.
