My feeling is that the whole manner in which this is being handled by the tape seller or part-copyright-holder will ensure that the tape never comes out. Without Ms. Spears' release and consent and 2257 documentation, any marketer profiting from the video will be a sitting duck. Also, rights of publicity would be a major issue with regards to Ms. Spears' name and likeness. The reason I think kfed is screwing this up is because he will probably end up in jail if he sells the content without consent and will not create the kind of atmosphere needed to foster a business partnership on the tape promotion with his co-copyright-holder.
Now, if you want an option to make some nice cash - one can discuss the rumours carefully on their blogs and landings and then have a link, maybe as "Readers also like FREE PICS from the Paris Hilton Sex Video" ad on the page linking to some HotelHeiress.com galleries or any of our other doorways. As always, publishers need to pay special attention to truth and representation when building out their landings.
