correct me if I'm wrong, but I think it is legal if a legitimate user (not connected to the website) uploads that content, but if the webmaster uploads the content themselves or hires and directs someone to do that upload, then it is no longer legal... I'm not a lawyer though so my interpretation may be off, feel free to correct it
(speaking here about unauthorized content of course)
