While I understand your point and almost agree with you, fansubs are considered copyright infringement by every country adhering to the Berne Convention:

They are not considered parody because they are not original works, I do not want to argue this because its a legal discussion, but fansubs are removed from youtube and the internet everyday because of DMCAs/Cnds/whatever method.
